Mediation
Mediation is an alternative form of dispute resolution which involves an extensive, interactive, and assisted negotiation process.
Basically, mediation is the process of resolving any dispute where a neutral third party assists the disputing parties in resolving the conflict by means of specialized interaction and negotiation techniques. The process of mediation is highly focused on the needs, rights, and issues of the clients and hence requires their active participation during the proceeding. The mediator ensures that the parties find the optimal solution to the ongoing dispute. The main benefit of mediation is that it can be conducted peacefully and is accepted internationally.
Some of the characteristics of mediation can be listed as follows:
- Collaborative: Mediation is a collaborative process. It promotes mutual understanding between parties as the disputing parties are made to interact with each other.
- Controlled: Mediation hands over the decision making power to the involved parties. They have a choice in following the decision or taking other steps.
- Confidential: The entire proceeding of mediation is confidential.
- Neutral and Impartial: The mediator is neutral and assists the parties involved in an impartial manner.
- Mutuality: The disputing parties can mutually reach a resolution.
